West Chester, PA Disability (SSDI) Lawyer

Sometimes, an injury, disability, illness, or other hardship interferes with the ability to maintain steady work and earn income.  However, even if you are unable to work, your obligations still continue to pile up.  With or without the benefit of employment, you still have to pay your utility bills, purchase groceries, pay for healthcare, and other expenses.

This can quickly lead to a stressful financial situation which seems completely impossible to maintain.

Fortunately, help is available through the Social Security Administration (SSA) in the form of monthly SSI or SSDI disability benefits.  The SSA projects that these benefits will reach over 8 million disabled workers in 2014 alone.  But while SSI and SSDI are powerful resources, obtaining them can be very difficult.  Statistically speaking, the majority of disability claims are rejected by the SSA, and many denied applicants will be left to struggle with the complex appeals process.

When you’re facing such challenging odds, you need to make your claim as strong as possible.  The attorneys of Young, Marr, Mallis & Associates can help.  To schedule your free, private legal consultation with a West Chester, Pennsylvania social security lawyer, call our law offices at (609) 755-3115 in New Jersey or (215) 701-6519 in Pennsylvania today.

How Our West Chester, Pennsylvania Social Security Attorneys Can Help

In a perfect world, people living with severe disabilities would be able to quickly and easily access SSA benefits.  Unfortunately, we don’t live in a perfect world, and the reality of the matter is that many applicants struggle with this complex and demanding application system.  In Pennsylvania, only about 30% of all claimants are approved after an initial review, meaning 70% — the vast majority — are denied for technical or medical reasons.  Claims examiners measure applications against very rigorous standards, and even seemingly minor omissions can lead to denial.  You need the support of an experienced legal team with a track record of helping clients succeed.

At Young, Marr, Mallis & Associates, we have more than 25 years of experience working with thousands of clients throughout all stages of the disability application process.

Whether you are preparing a claim for yourself or on behalf of your child, our dedicated attorneys have decades of practical knowledge to assist you.  We have handled numerous different medical conditions in disability claims, and have obtained millions of dollars in benefits for our clients over the years.

When you need a committed social security lawyer in your corner, you can call on Young, Marr, Mallis & Associates.

Types of Disability Benefits Available

Social security benefits are not uniform.  Instead, there are several distinct types of assistance which may be available to you based on your work history, financial background, and other factors.  You may be eligible for:

  1. SSI (Supplemental Security Income)
  2. SSDI (Social Security Disability Insurance)

While the acronyms sound similar, the criteria for enrollment into these programs is quite different. SSI is based primarily on financial need, meaning claimants must be able to demonstrate limited income and limited resources.  SSDI, on the other hand, is based on the applicant having already contributed a certain amount to the social security system, meaning candidates must have earned sufficient work credits.

Furthermore, there are many additional criteria the SSA imposes on social security applicants. For example, if you are applying for monthly disability, with a few exceptions you will typically need to demonstrate that your impairment:

  1. Has lasted for at least 12 months, is projected to last for at least 12 months, or is expected to end in death.
  2. Is not mild and manageable, but severe, meaning it prevents you from working.

You must also fall beneath certain income thresholds.  For example, as of 2014, if you earn more than $721 per month, you will not be considered disabled and eligible for SSI by the SSA.  The SSDI income limit is $1,070.

It is also important to point out that the SSA is not so concerned with the type of work you can do — just that you can work.  In other words, if your impairment precludes you from working at your normal, customary job, but the SSA determines you could take on alternative, less taxing work, you will not be considered disabled.
